Agreements and signature

This step replaces the paper waiver and medical form. Please read each part. Ticking a box is the same as initialling it on paper. If anything is unclear, email us before you agree and we will explain.

Coming every day

I will bring my child every day of camp. Camp runs for five days. If my child cannot come on a day, I will email Open Ice as soon as I know, so the place can go to a child on the waiting list.

Assumption of risk and release of liability

Please read carefully. By agreeing, you give up certain legal rights, including the right to sue for negligence. Take as long as you need. You may get independent legal advice before you agree.

In return for my child being allowed to take part in programs run by Open Ice Initiative Inc. ("OII"), including non-contact ice hockey instruction, skating, drills, off-ice activities and related programming, I, the parent or legal guardian of the child named in this application, agree to the following.

Nature of the activity. I understand that non-contact ice hockey and skating carry a risk of injury, including falls on the ice, collisions with other skaters or the boards, cuts from skate blades, being hit by a puck or stick, sprains, fractures, concussion and, in extreme cases, paralysis or death. I freely choose to accept these risks and to let my child take part.
Assumption of risk. I understand that these risks exist even when OII and its staff take precautions. I take full responsibility for any loss, damage or injury, including death, that my child may suffer by taking part in OII activities, whether or not it arises from the negligence of OII or its coaches, employees, volunteers, directors, officers, agents or affiliated persons (together, the "Releasees").
Release of liability and waiver of claims. I release, waive, discharge and agree not to sue the Releasees for any liability, claim, demand or action arising from any loss, damage or injury, including death, that my child may suffer, whether caused by the negligence of the Releasees or otherwise, to the fullest extent permitted by the law of Ontario.
Indemnity. I agree to indemnify and hold harmless the Releasees from any loss, liability, damage or costs, including legal fees on a solicitor and client basis, that they may incur because of my child taking part in OII programming, whether caused by the negligence of the Releasees or otherwise.
Occupiers' Liability Act. I am aware of the Occupiers' Liability Act, R.S.O. 1990, c. O.2, and agree that this release is a complete bar and defence to any claim under that Act or any other applicable law.
Insurance. OII holds general liability insurance for its programming. I understand that a claim arising from my child refusing to wear a CSA-approved helmet, or from breaking any other written condition of this application, may not be covered by that insurance.
Medical costs. I agree to be responsible for any medical costs that are not covered by my child's provincial health plan or private insurance.
Keeping this agreement on file. I agree that this agreement will be kept on file by OII and may be shown to OII's insurer on request.
Severability and governing law. If any part of this agreement is found invalid by a court in Ontario, the rest stays in force. This agreement is governed by the laws of Ontario and the federal laws of Canada that apply there.

I confirm that I have read this whole agreement, that I understand it, and that I have had the chance to seek independent legal advice.

I have read the assumption of risk and release of liability above, and I agree to it for my child named in this application.

Helmets and safety rules

Every skater wears a CSA-approved hockey helmet with a full cage, fastened, at all times on the ice. Open Ice provides one. A personal helmet must be CSA-approved, uncracked, complete and within its certification date, or we swap it for one of ours. This is a condition of our insurance.
A child who will not wear a helmet cannot go on the ice that session.
Full protective equipment is worn on the ice: the set Open Ice provides, or your child's own if it fits.
No body checking. Open Ice is non-contact hockey.
Listen to the coaches. Go on and off the ice only when a coach says so.
No horseplay, fighting or unsafe use of sticks.
Tell a coach about any injury straight away, however small.
A child who shows signs of a concussion stops right away and returns only with written clearance from a doctor.

I have gone over these rules with my child and agree to them, including the helmet rule.

Emergency medical treatment

If my child is hurt or unwell at camp and I cannot be reached in time, I authorize Open Ice staff and emergency responders to give first aid, call 9-1-1 and take my child to the nearest hospital. Staff will try to reach me first, then my emergency contacts.

Code of conduct

Our camp promise: be kind, listen to coaches, include everyone, and keep hands, sticks and words safe. Adults at camp treat every child, coach, volunteer and family with respect. Open Ice may ask a child to sit out, or ask a family to leave the program, if behaviour puts anyone's safety at risk.

I will go over the camp promise with my child and follow the code of conduct myself.

Photos and video

May your child appear in Open Ice photos and video?

We take photos and video at camp to share our work with families and supporters, including on our website and social media. We never sell them, and we never put a child's full name with a photo without asking first. Either answer is completely fine and never affects your child's place.

Privacy. I agree that Open Ice may use this information to review my application, run the camp, look after my child in an emergency and meet its insurance obligations, as described in the Privacy Policy (opens in a new tab).
